General Transport Conditions 2002 (AVC)

The General Transport Conditions 2002 are (transport) conditions that are often used for road transport within the Netherlands. These conditions are important in the event of damage. Based on these conditions, it can then be determined who is liable.

This AVC includes, among other things:

  • Obligations of the sender;
  • Obligations of the carrier;
  • Conditions for paying the freight;
  • Special risks;
  • Agreements for storage.

The conditions in the AVC are only valid when the sender and carrier agree to this. In that case, it is usually the case to use an AVC consignment note.

AVC consignment note

The sender and carrier make their own agreements in the AVC consignment note. This letter serves as evidence of great value in the event of damage during transport. The agreements in the AVC consignment note concern, for example, the following matters:

  • The type of goods;
  • The quantity of goods;
  • The weight of the goods;
  • The date of receipt and delivery.

The CMR Convention applies to international transport

For international transport, the CMR Convention often applies. It can be agreed that the AVC conditions apply in addition to the CMR Convention. The provisions of the law apply in full if the AVC 2002 have not been declared applicable and the CMR Convention does not apply.
