These conditions are the general conditions that can be declared applicable to any form of service provided by the forwarder. They are based on a broad interpretation of the forwarding agreement. All activities that the forwarder performs for the client fall under this.
Please note! These conditions are therefore different from the forwarding agreement as in Book 8 of the Dutch Civil Code.
The Fenex conditions apply to all services provided by the forwarder, including storage, distribution, customs clearance, insurance, packaging and repacking, weighing, marking, order picking, invoicing, and more. These Dutch Forwarding Conditions ensure a balanced distribution of rights and responsibilities between the parties involved.
The conditions contain provisions on various subjects, such as liability and the forwarder’s right of lien and retention. In addition, they offer a dispute resolution scheme for resolving conflicts between the forwarder and the customer. Instead of a regular court, disputes are settled exclusively by three arbitrators. However, if both parties agree, a dispute can be settled by one arbitrator.
Freight forwarders are the parties that have a cargo transported on behalf of the cargo interest. Freight forwarders often work on the basis of the Dutch Forwarding Conditions filed by FENEX, better known as Fenex conditions.
