Borrower liability

Hirer’s liability is a special form of joint and several liability for payment of payroll taxes and sales tax.

If the hiring organisation (e.g. temporary employment agency, secondment agency or subcontractor) does not pay these taxes, or does not pay them in full, the Tax Authorities may still collect these taxes from the hiring party. Hirer liability can be avoided by hiring from hirers that are affiliated with the Stichting Normering Arbeid, and by paying part of the invoice amount to the hirer’s G account, or depositing it with the Tax Authorities.
