If your transport company, warehousing company, or freight forwarding company has a claim against another party, it may be advisable to place a prejudgment attachment on the debtor’s assets. This way, the debtor can no longer withdraw these assets from recovery.

Prejudgment attachment

A prejudgment attachment may be levied on immovable property, on movable property (e.g. a truck or semi-trailer) on one or more bank accounts or among a third party who still owes money to the debtor.

In a claim arising from a contract of carriage, it is often clear from which party the sender still owes money. In transport law practice, this often provides a good means of obtaining security of payment.
